IT ALLOWS:

  • Child (Permanent) (Subclass 802 / Subclass 101) – when a child’s parent or their parent’s partner sponsors them to live in Australia as a permanent resident (and the child is in Australia)
  • Orphan Relative (Permanent) (Subclass 837) – when a relative sponsors an orphaned child to live in Australia as a permanent resident (and the child is in Australia)
  • Orphan Relative (Permanent) (Subclass 117) – when a relative sponsors an orphaned child to live in Australia as a permanent resident (and the child is outside of Australia)
  • Adoption Visa (Permanent) (Subclass 102) when a person who is an Australian citizen, holder of a permanent visa or eligible New Zealand citizen sponsors a child that they have adopted overseas to live in Australia as a permanent resident. A child who is in the process of adoption might also be able to apply for this visa
  • Dependent Child Visa (Subclass 445) when a child’s parent holds a temporary partner visa, and the child was not included in the temporary partner visa application

ELIGIBILITY & CRITERIA:

  • The applicant must be sponsored by an Australian citizen, a permanent resident of Australia or an eligible New Zealand citizen.
  • The applicant is required complete a health assessment to demonstrate they are not likely to incur excessive costs to Australian taxpayers through public health care, Family members who are not coming to Australia might also have to meet our health requirement.
  • The applicant must either be under 18 or aged between 18 and 25 and dependent on sponsoring parent or temporary partner visa holder. There is no age limit if the applicant is incapacitated for work due to loss of bodily or mental functions.
  • Applicants over the age of 16 and the sponsor must show that they are of good character, which requires police clearances for any country they have lived in for 12 months or more (cumulatively) within the past 10 years (from the age of 16 onwards). If either of them has a substantial criminal record (usually a prison sentence exceeding 12 months) they will fail the character test unless there are mitigating circumstances.
  • An assurance of support (AoS) is sometimes required for a Child Visa.

WHERE CAN I APPLY FROM:

  • When applying for a child visa (subclass 101) the applicant must be outside of Australia at the time of application and at the time of grant.
  • When applying for a child visa (subclass 802) the applicant must be inside of Australia at the time of application and at the time of grant.
  • When applying for dependent child visa (subclass 445) the applicant can be in or outside of Australia at the time of application. If the applicant is in Australia at the time of application, they must be in Australia at the time of grant. If the applicant outside of Australia at the time of application, they must be outside of Australia at the time of grant.
  • an Orphan Relative visa application can be made outside Australia (subclass 117) or in Australia (subclass 837).
  • An Adoption (subclass 102) visa application can only be made outside Australia.
